SUMMARY
The Declaration of CC&Rs is the legal document laying out the planned community’s guidelines. The CC&Rs are legally binding and recorded in the county records where the property is located. This means that when you purchase a lot or a home in a planned community, for example, you automatically become a member of the HOA.  These are the rules of the neighborhood.
